In the state of California, the California Department of Insurance defines a “bail agent” as a person permitted to solicit, negotiate and affect undertakings of bail on behalf of any surety insurer. (Section 1802 of the California Insurance Code) Bail agents must be California residents and at least 18 years of age. Pre-licensing and education requirements are 20 hours of approved pre-licensing classroom study in subjects pertinent to the duties and responsibilities of a bail licensee, including, but not limited to, all laws and regulations related thereto, rights of the accused, and ethics. Bail bond agents must also keep up with continuing education, which requires a minimum of 12 hours of approved classroom study prior to the renewal of his/her license.
The California Department of Insurance also sets the bond premium for bail bonding services in the state at 10 percent of the total bail amount. This is a nonrefundable amount that the bail bond agent receives in return for posting the bail to release the defendant. Bail bonding companies that offer discounted services, particularly those under 8 percent, may be acting outside of the California Department of Insurance regulations and caution should be used when using their services.
